Encroachment on Public Land: How to Report It Effectively

Encroachment on public land — footpaths turned into shops, parks converted to parking lots, stormwater drains built over — is one of the most widespread civic problems in Indian cities. It is also one of the hardest to solve, because encroachers frequently have political connections that shield them from enforcement.

What Counts as Encroachment

  • Shops or vendors occupying footpaths permanently
  • Vehicles parked on footpaths obstructing pedestrian movement
  • Illegal construction on government or municipal land
  • Covering or blocking stormwater drains for construction
  • Conversion of public parks to commercial use without tendering

The Legal Framework

Encroachment on public land is governed by the Public Premises (Eviction of Unauthorised Occupants) Act 1971 at the central level, and by state-specific land encroachment acts. The Supreme Court in several judgments has held that "right to footpath" is part of the right to life under Article 21 — meaning a blocked footpath that forces pedestrians onto the road is a constitutional violation.

Who to Complain To

For footpath encroachment: Municipal Corporation's enforcement or anti-encroachment cell. For government land: the District Collector or Tehsildar's office. For national highway encroachments: NHAI's regional office. In all cases, also file on Seedhi Baat to create an MP-level record.
